mass sms / texting for site promotion - how legal?

Hey I signed up for an account for broadcasting mass sms / txt messages and webchat-to-text feature.. I have this specifically to promote my site to those who subscribe to my mobile updates.
My question is however, if a mobile user subscribers to my alerts, can they report it as harassment if they decide they no longer want to receive the messages even after they subscribed themselves?
I heard this solution is much more effective than twitter or all the other social networking sites out there.

That would depend on the area that you're sending these SMS messages, and the carriers involved.
