Yes, I am going to create one of my own. The idea I have for my favicon is however something that is very possible to be already out there on some website somewhere. I just wanted to confirm that mine has not been replicated before.

But could you confirm me whether favicons have a copyright. Like, can I be held guilty because my favicon is same as for some other website that has registered its favicon or something...

Favicons would be subject to the same copyright laws as any other published item. I cannot say for certain, but I doubt anyone copyrights only a favicon. But if the web site is, the favicon is probably included. However, if a copyright is not filed, the item is still protected under copyright laws. The only difference in filing and not filing for a copyright is the type of damages you can sue for: without a filing only actual damages; with a filing actual damages, punative damages, and legal fees. Of course, i am ONLY talking about US copyright laws as I am not familiar with outher countries' laws.
