New Pop Over Adsense Placement

Over the past month, I've noticed sites like wallstcheatsheet.com using a new Adsense placement. The placement seems to be a 728x90 pop over which I thought was illegal. The 728x90 banner pops up at the bottom of the screen when you scroll down an article.

Does anyone know if this ad placement is allowed, and has anyone tested this placement?

Not to be pedantic but 'non-compliant with adsense rules' is better than 'illegal'
But no, it is not allowed unless you have made a special arrangement directly with google eg if you are a premium publisher. Although I've seen it on a couple of sites myself recently as well.

It could be that they are unaware of the ad's activity. You need to disable that kind of behavior in your ad choices.

The size mentioned is called a "Large Leaderboard" and it is designed to expand from 90px height to 415px. They would need to opt out of "Expandable Ads" to prevent the ad from showing up.

I can't say for sure but I suppose it might also happen if they use the so-called Responsive Ads that take all the real estate they are not restrained via css from taking.
