Would this be against adsense TOS? I am testing new positioning, so I made a menu on the left with same color, font, spacing, as the adsense block on the right.

Why not read through the TOS yourself?
I've always worked on the assumption that if you have to ask, don't do it.

After seeing the new adsense guidlines I think it is against the TOS.
How about the double 336 x 280 at the top of the page (above fold) all alone. Would this be against TOS? I see that they suggest we keep ads below the fold, but I don't see them saying clearly they will ban you for putting ads above the fold. Any opinions on this?

Where do they suggest keeping ads below the fold? A double 336x280 above the fold with no content, though, is a bad idea.

Here is one I saw recently, it seems to say the double block above fold is not allowed.
How about just one or two ad units that aren't placed in areas where one is expecting on site links? What's your goal with placing ad units like that on the page?
