Is Google legally responsible to demote malware infected sites?

I'm seeing a lot of sites ranking 1-3 with the message "This site may be compromised".

Question, if Google knows this, should the site not be immediately penalised as higher property than ANY other quality control offence?

Since this kind of site can actually damage the end users entire computer system, costing thousands in some cases, should the site not be quarantined from the serps?(until the malware is removed)

Can google be legally held responsible for continuing to promote malware infected websites, sites they KNOW are compromised?

Of course if the site just vanishes from the SERPS the owner will probably waste days trying to identify SEO issues rather than fixing the real problem.
