First DMCA - experiences ?

Any advice before submitting DMCA

At first I thought see this guys site was innocent enough as there are a lot of websites and brands with similar names. But eventually he became more and more similar. At first they only started a similar name, eg webmasteringworld, doing some similar IT business. Now i see they have a new site with similar name imitating my brand further to the point i have no choice but to file DMCA.

Looking for any advice or experiences. I have read i need to email a cease and desist first but not sure how long i have to give him to remove it before DMCA is filed.

Also, my trademark is only registered in Canada not the US, does that mean I'd be wasting my time ? because he didnt actually copy content, just brand name and business model.

DMCA's are for copying content.

That's not DMCA. DMCA is for copying your website's content. The problem you are facing is trademark infringement

It is confusing. The DMCA page on Google has nothing about trademark infringement yet a number of sites publish material suggesting they do. Can't afford a lawyer anyways, seems like there is little recourse for small business in this case.
