I just went to Boston dot com and chose an article at random. There I found a "Share This" link which Pops up a choice of sites it will help me insert a link or a post. These sites are:
Reddit, Facebook, Stumbleupon, Technorati, Digg, Delicious, Mixx, Newsvine, Blogger, Live Journal, Orkut, Twitter, Myspace, Wordpress, TypePad and Friendster.

Now, when they invite this sort of Scatter Gun Linking and Posting, do they have any defence on other Linking that happens unilaterally on the Merit of the Article itself?

I am wondering if there is a history that is not public. Is it possible that NYT have previously refused to licence content from this company or there is a quibble over pricing? You generally dont just jump into a lawsuit without some attempt at negotiation. There has to be more to this, I think

How about when some pedo site links to your day care center?

I would block anything from that site and report it. I wouldn't sue them and try to change the way we use links on the Internet.

I would say that you're right... generally a reasonable person would not litigate immediately.

However these old-timey media companies use litigation as the conversation starter more often than not.

Big corporate media are litigation factories and really and truly represent all that is bad in America today.

There's a growing grassroots groundswell that wants media reform in the USA.. we really do need it.
