Yahoo! Images Copyright Question

This one is nasty.

The problem: A site (let's call it widget.com) has built a full site around Yahoo! services. News - powered by Yahoo! Answers - powered by Yahoo! Search - powered by Yahoo! and so on and so on. You get the idea.

One could easily think this is a Yahoo! site.

But it is not.

Now, this guy also runs an Image Search, yes, powered by Yahoo! And indeed a search for terms specific to my sites returns a lot of thumbnails, all hosted by Yahoo! (Right click - Properties shows blah1.blah2.yimg.com as image host)

Now, I can not remember having Yahoo! authorized to sub-licence the thumbnails to any site other than Yahoo! Image Search (I think the service is useful, but sub-licencing was not in my intention). But still thumbnail representations of the pictures appear on widgets.com. Of course, next to ads and affiliate links, powered by (you guess it) Overture, a Yahoo! company.

I would love to go after widget.com for copyright infringement, and want to collect opinions of WW members whether it is worth it? (For now, I have blocked Yahoo MM Crawler in my robots.txt - never got much traffic from Yahoo! anyway.)

What's your take on this?

Thumbnails are apparently fair use [webmasterworld.com...]
