What to expect of the upcoming EU Digital Services Act?

Hello,

What kind of new burden are the technocrats of Brussels going to give us?

This December, the EU commission is going to present the Digital Services Act (DSA) (project), a package of stuff to regulate the Internet.

As usual, they keep claiming this is to control and regulate the big tech companies, but, as usual, all these rules will apply to anyone , up to the small and micro businesses, like it was the case for the GDPR, which, at first was for businesses over a given size, but ended to apply to every single business of any size.

Okay ... I must have taken a nap. When did this come about? GDPR is not collecting enough in fines (taxes)? New money stream?

Some background for those not up to speed...

The current overarching European Union online services legal/regulatory framework is the ECD (e-Commerce Directive (overview) [ec.europa.eu] adopted in 2000.

A lot has changed in 20 years.

The European Commission is expected to offer up the DCA (Digital Services ACT) first draft proposals for updating - and expanding - the ECD 02-December-2020. Between June and September of this year there was a public (including online questionnaire) consultation process.
Note: the European Parliament has already published it’s own recommendations.

While the EC’s questionnaire and the EP’s recommendations provide an outline of their concerns we’ll have to wait several weeks yet to get a look at the nuts and bolts.

One aspect that has been getting a lot of attention is that of ‘gatekeepers’ such as Google, Amazon et al and how best to identify and regulate acceptable and unacceptable behaviours. Another is to standardise self-employed, including ‘gig economy’, workers benefits and protections.

Etc.

It will probably be 2022 before things are finalised - remember that each EU member state will need to sign on and pass.

But it’s still a month and more before we can actually have a knowledgeable conversation on the DCA. Something to look forward to...
