The Internet Archive has lost its appeal over e-book lending.

It says, "We are disappointed in today’s opinion about the Internet Archive’s digital lending of books that are available electronically elsewhere. We are reviewing the court’s opinion and will continue to defend the rights of libraries to own, lend, and preserve books. " [blog.archive.org...]

Illustrating once again that misguided* judges are not confined to any one geographical region. The more bloated a copyright term gets, the more “orphan books” become a problem.

It appears that once you get on the target list you will get hammered, and the archive.org is a big target. Meantime, the small-scale copyright theft continues unabated.

But how is lending out a book that you own “copyright theft”? I don’t see anyone demanding that public libraries throw out all post-1928 material.
