The holes and flaws in America's copyright law are under serious review thanks to two decisions by the US Ninth Circuit Court of Appeals – both of which come with significant implications for media companies.

But, if the Trump Administration has anything to do with it, one of those flaws will not be tackled by the Supreme Court because it might lead to a big media company losing a decade-long legal battle.

At issue are two cases: one covering copyrighted celebrity pictures posted to an online forum, and the other a YouTube video showing a baby dancing. Both dig into how much effort should be required by people to look into copyright issues if they want to avoid being held liable.

More serious note, it is well past time to revisit copyright in the web. There are Creators of content getting terribly screwed. Now, if only we can address how the search engines pilfer content it might be happy daze (sic) again.

There is something stressing me a lot.

I have a forum, and people posted some photos sometimes, to illustrate their claims, or things like that. But I don't know if some of these photos are copyrighted or not. I have a message stating that if you post a photo, you need to ensure you are doing it in a legal and fair way, but I don't know if people are really minding instructions! So, last year, I decided to pre-moderate all messages, and disallow photos. But I can't go through all the posts made before and it worries me a lot. I have a a button to report issues, and also, I made so that images be re-sampled to 150 x 150 pixels. I thought it 's small enough to be informative only.

What's your thoughts ?

Also, I am in Spain, what if an American (individual or company) wants to sue me ? How can I find a lawyer to represent me overseas ?

Ps: of course if one day, someone asks me to take down images, I'll do it immediately, without trying to challenge this.

There is something called fair use and what you describe will likely fall under that.

That said, your problem is not being sued, specially since you are in Spain. It is unlikely that anyone will go through the expense of trying to sue you overseas. How much could they possibly claim before you go bankrupt? The bigger risk in my view is if your are using AdSense. Posting copyrighted content without permission is against AS policies and that can get you banned.

Further to that point as it relates to this topic, for the reason described above, any changes to the copyright laws could have big implications for Adsense publishers that have had content that was previously acceptable. This could cause publishers that have older content to review, delete or modify countless pages. This could amount to a significant cost for some.

Thank you NickMNS, it's making me feel relived. I know I am silly, but everything worries me easily :). As for adsense no problem, I also prevent it from showing on page with photos posted, just to be sure.
