German DMCA Equivalent? Help with a Host in Germany

European Equvalent to DMCA

For weeks I've been sending off DMCA notices to hosts mainly in the US, but my list for one site that's hosted by a large host in Germany keeps getting longer as I find more and more copied content.

I don't see any information for reporting anything to this host as most hosts will offer a mailing address and department or a form to fill out or a standard abuse@example.com email. Best I can find is a mention of the Telecommunications Act and Teleservices Act.

Any experienced help on this matter?

My instant response-- seeing only the topic title-- is "Oh, them again? Forget it" ;) but someone may know something.

By the usual predictable coincidence, it is not 24 hours since I mentioned in an unrelated thread that some hosts are "Shoot On Sight", and this may be one of them. ymmv

Pretty worthless host eh? Maybe that's why this site resides there.

The European equivalent for a DMCA is covered by the Electronic Commerce Directive, article 14 specifically. You can find information at wikipedia on that and more authoritative help at ChillingEffects.org - there is a link to that site in the Charter of the Content, Writing and Copyright Forum.

Another tactic is after filing the legalities, you can also file with Google. They have nothing to do with removing your content from the host, but they can and do remove it from the SERPs. Not an overnight solution. You can find the form through an article Matt Cutts put out, available here: [searchenginewatch.com...]

Thanks not. Yea, the Google DMCA is one resort...the last. What bugs me is the structure of this site as their activities will just worsen as time moves forward. The actual website name is widgetpost.com. Widget replacing the actual industry term. So essentially they take four or five content articles each day and paste them to their site.

I've been through the site and discovered a few dozen copied pages, but recognize a large number of others I'm familiar with. I just feel it's going to be a constant mole whacking problem. Even reaching to the host may not help as they can just set up shop with another host.

Which leads me to another question. How effective is reporting the site to adsense? After all, that's the only reason they exist, or so it seems.
